The Guarantee
1. CSR Building Products Limited ABN 55 008 631 356 (“Hebel®”) warrants for 7 years from the date of purchase that AAC Products and/or Hebel® Branded Products manufactured by Hebel® shall not materially degrade or break down and that no such products shall be materially affected by corrosion of any metal inserted by Hebel® in the manufacture of such products. When used in walls, floors and roofs designed and constructed to comply with Hebel’s® Technical Manual, Design & Installation Guides and any other Hebel® manuals relevant to that particular Hebel® product or system which is current at the time of use, Building Code of Australia, relevant Australian Standards and relevant ABSAC Technical Opinions, Hebel® warrants that the AAC products and/or Hebel® Branded Products will retain their structural strength and stability for 7 years.

2. The above warranties will not apply if:
3.(a) the products are handled or installed other than in accordance with Hebel’s® Technical Manual, Design & installation Guides and any other Hebel® manuals relevant to that particular Hebel® product or system which is current at the time of use, Building Code of Australia, relevant Australian Standards and relevant ABSAC Technical Opinions;
(b) the appropriate surface coatings are not properly applied and maintained on surfaces of the products (See Hebel®; High Performance Coatings Brochure for technical specifications and recommendations; or
(c) the products are subjected to conditions which would normally be deleterious to conventional concrete products (e.g. acidic environments).
4. Pursuant of section 68A of the Trade Practices Act (“Act”) this clause applies in respect of any of the AAC Products and/or Hebel® Branded Products which are not of any kind ordinarily acquired for personal, domestic or household use or consumption, provided that this clause will not apply if the customer establishes that reliance on it would not be fair or reasonable. Hebel’s® liability in respect of breaches of express or implied conditions and warranties, other than the warranty as to title, is limited to any one of the following as determined by Hebel®:
(a) the replacement of the AAC product and/or Hebel® Branded Products or the supply of equivalent AAC products and/or Hebel® Branded Products;
(b) the repair of the AAC products and/or Hebel® Branded Products;
(c) the payment of the cost of replacing the AAC products and/or Hebel® Branded Products or of acquiring equivalent AAC products and/or Hebel® Branded Products; or
(d) the payment of the cost of having the AAC products and/or Hebel® Branded Products repaired.
Hebel® shall have no liability arising out of or in connection with special, consequential, direct or indirect loss, damage, harm or injury suffered or incurred as a result of such a breach unless and then only to the extent that such a liability is imposed on Hebel® by the Act.
5. Certain other conditions and warranties may be implied by the Act and by State and Territory legislation. Such conditions and warranties are negated unless such negation is specifically forbidden by that legislation.
